I assumed by my reading that Ashly was the “fellow judge in Hannah Dugan’s courthouse delivered damaging testimony against her.” Obviously I could be wrong. The text was confusing (to me). I have no thoughts on what he “should” have done let alone what he “could” have done. In any case I think we both agree that this is a very important case that bears watching. I’ll revise the lede for further clarity. I was referring to Judge Kristela Cervera’s testimony, which was far more adversarial to Dugan. In multiple ways, Ashley’s testimony may have helped the defense.

What exactly is meant by public area? Hallways? Stairways? Courtrooms?

It seems that he didn’t want to affirmatively welcome it, because he didn’t like it, but he thought the state had no power to prevent it
