Under the President's current structural exploit, if he issued an Executive Order, or the OLC issued a Memo, that Article II permits him to hang people out the window by their feet until they see things his way, he could start doing that tomorrow, and you might have to fight that all the way up to the supreme court, while hanging out a window by your feet, but first spend a year fighting about whether you have standing, because gravitational harm is speculative (maybe there’s a really big pillow.. the doj might say - who’s to say?). The petition clause is a check on the executive. You can file a case asking the court to declare “Article II does not support that assertion, at all, and is far too vague to be binding on the DOJ, this order is void”. Otherwise, we’d be living in a place where the president could do that, and stick tax payers with the bill if he decides to drop you. “ooopsies”
These magas are absolutely terrified of loosing the mid terms.. we need to prepare NOW for that... also more of the r's in congress could just retire and upset the balance which might help when we go to vote
